This document, together with any documents referred to herein, sets out the terms and conditions governing the use of this website, sportcarstech.gr, and the purchase of products through this website (hereinafter, the “Terms”).

The website sportcarstech.gr is an online store for the sale of products via the Internet (hereinafter referred to as the “Online Store”, the “Website”, or the “Site”), created and operated by Technologia Sport Aftokiniton S.A., with its registered office at 299 Syngrou Avenue, 17122 Nea Smyrni, Athens, Greece, VAT No. 094383621, Tax Office FAE Piraeus (hereinafter referred to as the “Company”).

The following terms and conditions shall apply to the use of the Online Store under the trade name SPORTCARSTECH, located at the web address sportcarstech.gr. Any user who accesses, transacts with, or otherwise uses the services of the Online Store (hereinafter referred to, as applicable, as a “Visitor”, “User”, or “Customer”, depending on whether such person merely visits the Site or also places orders and purchases products and/or services) shall be deemed to have read, understood, and unconditionally accepted these Terms, without any exception.

If any User does not agree with these Terms, they must refrain from visiting, using the Website, and carrying out any transaction or use of the services of the Online Store. Any action taken by the User on the Online Store, including, without limitation, browsing the Website, subscribing to the Company’s newsletter, or purchasing products, shall constitute unconditional acceptance of these Terms of Use.

The Company reserves the right to amend or revise these Terms and the conditions governing the use of and transactions through the Online Store at any time it deems necessary. The Company undertakes to inform consumers of any such changes through the Website. Any amendments shall take effect from the date of their publication on this Website. It is clarified that any such amendment shall not affect orders already placed by the Customer through the Online Store prior to the effective date of the amendment. Continued use of sportcarstech.gr following any such amendment shall constitute acceptance of the Terms as amended.

By accessing, browsing, or using our Website and/or its services, you represent and warrant that you are at least eighteen (18) years of age.

1. Information Provided and Products

The Company is committed to the accuracy, truthfulness, and completeness of the information presented in the Online Store, both with regard to the identity of the Company and to the transactions carried out through the Online Store. Acting in good faith, the Company shall not be liable for, nor bound by, any electronic data entries made by mistake or oversight and reserves the right to correct them whenever such errors come to its attention.

The foregoing is subject to any technical or typographical errors that may not have been foreseen or may have arisen unintentionally, as well as to interruptions in the operation of the Website or events of force majeure. In any event, if any price appears to be unusually high or unusually low, you are advised to contact us before completing your order.

All prices displayed for products are final and include 24% VAT. Customers outside the European Union may be subject to additional charges, including but not limited to customs clearance fees, import duties, product restrictions, and other local requirements, for which the Company shall bear no responsibility.

2. Website Availability

The Company makes every effort to ensure the maintenance and availability of the Website and its content. However, the Company may, at any time and without prior notice, suspend the operation of the Website, in whole or in part, either temporarily or permanently, for reasons including maintenance, upgrades, or any other reason, and may amend its content accordingly.

The Company shall bear no liability for any damage arising from Users’ inability to access the Website.

3. Limitation of Liability

Within the framework of transactions carried out through the Online Store, the Company shall not be liable and shall have no obligation to compensate for any loss or damage arising from the cancellation of orders, non-performance, or delayed performance of orders, for any reason whatsoever.

The Company does not guarantee the availability of products displayed in the Online Store. However, it shall inform the interested Customer, based on the records maintained, of the availability or non-availability of products and, in the event of any change to such records, undertakes to inform Customers promptly of any unavailability. In such cases, the Company shall bear no further liability.

In accordance with good faith and fair business practices, the Company shall not be obliged to accept any order or conclude any sale of products and/or services which, due to a typographical, clerical, or technical error, are displayed in the Online Store at an incorrect price, whether lower or higher than the price applicable during the relevant period.

Where such pricing error affects only part of an order, the order shall remain valid and shall be fulfilled with respect to the remaining products, while it shall be deemed incomplete only with regard to the products affected by the error, unless the ordered items are related, intended to be used as a single set, and function as a unit, and the Customer declares that partial fulfilment does not serve their needs or interests. In such case, the Company shall cancel the order in its entirety.

The Online Store provides the content, including but not limited to information, names, photographs, and illustrations, as well as the products and services made available through the Website, on an “as is” basis. Minor deviations in colour, size, and/or shape may occur between the product displayed on the Website and the product received by the Customer.

Under no circumstances shall the Company be liable, whether civilly or criminally, for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, loss of income, or monetary satisfaction, suffered by any Visitor, User, Customer, or third party for any reason related to the operation or non-operation of the Website, the use thereof, any inability to provide services, products, or information made available through it, or any unauthorised intervention by third parties in products, services, or information made available through it.

The Company does not warrant that this Website, any related website, or the servers through which they are made available are free from viruses or other harmful components.

The Website does not guarantee, under any circumstances, the correctness, completeness, or availability of its content, pages, services, options, or the results thereof.

4. Accuracy of Billing and Account Information

The Company reserves the right, at its sole discretion, to refuse, limit, or cancel quantities purchased per person or per order. Such restrictions may include orders placed through the same customer account, using the same credit card, and/or using the same billing and/or shipping address.

If an order is modified or cancelled, the Company may attempt to notify the Customer by contacting the email address, billing address, or telephone number provided at the time the order was placed.

The Company reserves the right to restrict or prohibit orders which, in its sole judgment, appear to have been placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made through our Online Store. You further agree to update promptly your account details and any other information, including your email address and your payment card details and expiry dates, so that we may complete your transactions and contact you as necessary.

5. Links to Third-Party Websites

The Website sportcarstech.gr does not control the availability, content, privacy policies, quality, or completeness of the services of other websites and web pages to which it may refer through links, hyperlinks, or advertising banners.

Accordingly, for any issue arising from your visit to or use of such third-party websites, you must address the relevant website or page directly, as such third parties bear sole responsibility for the provision of their services.

Under no circumstances shall the Company be deemed to endorse, accept, or otherwise be connected with the content or services of such third-party websites.

6. Social Media

Users and Members may follow the Company through its pages on Facebook and Instagram (hereinafter “Social Media”) in order to stay informed about its news, submit comments, and participate in promotional activities.

Any products or services offered through Social Media, as well as any information communicated, submitted, or offered through the Company’s Social Media accounts, shall be subject to these Terms, unless otherwise agreed.

Interaction with Social Media may also allow access to and connection with your personal Social Media accounts. The Company has no access to and no control over such services and therefore accepts no responsibility for any acts and/or omissions of the providers of such social networking services. For this reason, you are advised to read carefully the terms and conditions governing such platforms.

7. Intellectual Property Rights

This Website is the official online store of Technologia Sport Aftokiniton S.A. All distinctive titles, trademarks, images, graphics, photographs, designs, texts, and any other content on the Website constitute the intellectual property of the Company or its respective rights holders and are protected under the relevant provisions of Greek law, European law, and international conventions.

Any copying, analogue or digital recording, mechanical reproduction, distribution, transfer, adaptation, resale, creation of derivative works, or misleading of the public as to the actual provider of the Website content is strictly prohibited.

The reproduction, republication, uploading, announcement, dissemination, transmission, or any other use of the Website content, by any means or medium, for commercial or other purposes, is permitted only with the prior written consent of the Company.

The names, images, logos, and distinguishing features representing the Online Store SPORTCARSTECH, or third parties and their products or services, are exclusive trademarks of the Company or of the respective third parties, protected under the applicable trademark laws and EU and international legislation. Their appearance on the Website shall in no way be construed as granting any licence or right to use them.

8. User Responsibility

Users agree not to use the Online Store of sportcarstech.gr to send, publish, transmit by email, or otherwise communicate any content that is unlawful, harmful, threatening, abusive, offensive, harassing, defamatory, vulgar, obscene, libellous, invasive of another person’s privacy, discriminatory, or likely to cause harm to minors in any way.

Users shall also refrain from any intentional or unintentional violation of applicable Greek and EU law, from harassing third parties in any manner, and from using any content for the collection or storage of personal data relating to other users.

9. User Registration

Registration on the Website is optional. Each Customer may register only once.

By using the unique combination of Email Address (“EMAIL”) and Password selected and declared by the Customer, the Customer is granted the following options:

• to view the contents of their shopping cart (“My Cart”). The Cart displays the products selected by the Customer for ordering. The Customer may place orders for products and may review or amend them, including by deleting items or changing quantities, at any time before the completion of the order;

• to complete the order and make payment by selecting one of the payment methods made available by the Online Store;

• to modify the Customer details of their Account.

Registration and participation are free of charge, personal, non-transferable, and non-assignable. The User is solely responsible for the information provided to the Company, and the Website relies exclusively on the User’s statements regarding their personal data.

The information entered during registration must be complete, true, and up to date. In the event of registration by a legal entity, the name of the contact person and the full corporate name of the legal entity must also be stated.

In the event of any change in such information, the User is obliged to inform the Company immediately so that such information remains complete and accurate at all times.

The personal data provided by the User during registration shall be processed by the Company exclusively for the following purposes:

• the creation of an account on sportcarstech.gr;

• communication with the User regarding transactions with the Company, including, by way of example, communication necessary for the completion, shipment, and delivery of the order, payment processing, and the secure completion of the financial transaction;

• the sending of informational, advertising, and promotional material relating to the Company’s products and services, including collaborations with third parties.

With regard to the collection and processing of personal data, the provisions of the Privacy Policy shall apply.

By registering, the User expressly consents to the collection and processing of their data in accordance with these Terms of Use, the Privacy Policy, the Cookie Policy, and any amendments or updates thereto, all of which the User declares to have read, understood, and accepted fully and unreservedly.

The User may withdraw such consent at any time with respect to the collection and processing of their personal data by requesting the deletion of their user account via email to info@sportcarstech.gr.

In addition, the User has the right, at any time, to access their data and may request the immediate deletion or correction thereof, the temporary suspension of their use by the Company, their restriction, or their non-transfer, by following the same process and sending the relevant request by email.

10. Personal Data Protection

The processing of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR 2016/679), any specific national and European legislation applicable to particular sectors, the applicable Greek legislation on the protection of personal data, as well as the legislation governing the protection of personal data and privacy in the field of electronic communications (Law 3471/2006, as in force from time to time), and the decisions of the Hellenic Data Protection Authority.

11. Security and Confidentiality of Transactions

All information transmitted by Users to the Online Store is treated as confidential. In particular, in order to safeguard your personal data and electronic transactions, the Company has adopted the following security mechanisms and methods:

11.1 User Identification and Access Authorisation

In order to carry out any electronic transaction with the Company, the creation of a personal account in the Online Store is required. Access to this account requires the use of a username and password, chosen and known exclusively by the User.

11.2 Use of SSL Technology (Secure Sockets Layer)

The Company considers the security of its Website and the personal data of its Customers to be of utmost importance. The Company confirms that your data is transmitted using SSL Certificates, enabling secure connections between a web server and a browser. 12. Newsletters

The newsletters received by Visitors/Users of the services of sportcarstech.gr following their subscription to the mailing lists constitute the intellectual property of the Company and are therefore protected by the relevant provisions of Greek law and international conventions.

The Company reserves the right not to register any person on the mailing lists or to remove any person therefrom.

The use and/or exploitation of the free services provided by the Website implies the unconditional acceptance by Visitors, Users, and Members of receiving advertising messages (emails) both from the Company itself and from the other companies of Technologia Sport Aftokiniton S.A., as well as from third-party partners of the Company. In all cases, such communications shall be sent exclusively by the competent department of the Company.

13. Indemnification

You agree to indemnify and hold harmless the Company, as well as any third party deriving rights therefrom, including partners, employees, suppliers, agents, and representatives of both the Company and its partners, against any loss, damage, cost, or expense arising from:

(a) any breach by you of these Terms in connection with the use of the Website and the services provided through it, including purchases from the Online Store;

(b) your failure to comply with these Terms;

(c) your breach of applicable law;

(d) your infringement of any third party rights relating to the protection of personal data; and/or

(e) your infringement of the Company’s intellectual property rights.

All limitations of liability set out herein shall apply in full, as valid and consistent with good faith and fair business practices, and Users expressly consent to such exclusions and limitations.

14. Governing Law and Other Terms

These Terms and any amendment, modification, or variation thereof shall be governed by and construed in accordance with Greek law, European Union law, and the relevant international treaties.

If any provision of these Terms is held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity of the remaining provisions.

Any failure by the Company to exercise any of its rights under these Terms shall not constitute a waiver of such rights.

These Terms constitute the entire agreement between the Company and the Visitor/User of the Website and its services and shall bind only those parties.

No amendment to these Terms shall be valid or form part of this agreement unless made in writing and incorporated herein.
